DISTRICT ATTORNEY VANCE ANNOUNCES GUILTY VERDICT IN TONY SIMMONS TRIAL

NYC Department of Juvenile Justice Counselor Convicted of Criminal Sexual Act and Sexual Abuse

Manhattan District Attorney Cyrus R. Vance, Jr., today announced a guilty verdict in the trial of TONY SIMMONS, 47, a New York City Department of Juvenile Justice employee, who sexually abused females in his custody at Manhattan Family Court. A jury convicted SIMMONS of Criminal Sexual Act in the Third Degree, Sexual Abuse in the Second Degree, and Sexual Abuse in the Third Degree.

“This defendant had a duty to guard and protect these teenagers,” said District Attorney Vance. “Instead, he abused the authority of his position to sexually assault girls in a situation where they were most vulnerable.”

According to the evidence presented at trial, on July 3, 2008, while in Manhattan Family Court, the defendant engaged in sexual conduct with a 15-year-old female. It was discovered that another female teenager had reported in December of 2005 that the defendant sexually assaulted her while she was awaiting a court appearance in Manhattan Family Court.

District Attorney Vance thanked Assistant District Attorney Evan Krutoy, who handled the prosecution of this case under the supervision of Assistant District Attorney Kerry O’Connell, Chief of Trial Bureau 80; Assistant District Attorney Lisa Friel, Chief of the Sex Crimes Unit; Assistant District Attorney Audrey Moore, Chief of the Special Victims Bureau; and Executive Assistant District Attorney Karen Friedman Agnifilo, Chief of the Trial Division. DANY Senior Investigator Edward Tacchi and Trial Preparation Assistant Jon Wilcon also assisted in this case.

A class E felony is punishable by up to 4 years in prison, a class A misdemeanor is punishable by up to 1 year in jail, and a class B misdemeanor is punishable by up to 90 days in jail.

Mortgage Fraud

Manhattan District Attorney Robert M. In addition, 12 individuals have already waived indictment and pleaded guilty to felonies relating to their participation in the mortgage fraud scheme. The indictment charges 13 individuals and the mortgage company, AFG FINANCIAL GROUP, INC., with enterprise corruption, grand larceny, scheme to defraud and conspiracy involving 19 fraudulent mortgage transactions. The defendants include the principals and a number of employees of the mortgage company, as well as bank employees, appraisers, and three attorneys. DISTRICT ATTORNEY VANCE ANNOUNCES INDICTMENT OF SIX SUBCONTRACTING COMPANIES AND THEIR OWNERS IN MULTIMILLION-DOLLAR FRAUD

Manhattan District Attorney Cyrus R.
