JOSEPH PABON HAS BEEN SENTENCED TO 25 YEARS-TO-LIFE IN PRISON FOR 2009 MURDER AT LOWER MANHATTAN OFFICE BUILDING

Manhattan District Attorney Cyrus R. Vance, Jr., today announced the sentencing of JOSEPH PABON, 28, to 25 years-to-life in prison for the murder of Eridania Rodriguez in July 2009. On April 2, 2012, PABON was convicted by a jury of Murder in the Second Degree and Kidnapping in the First Degree.

“The defendant brutally and senselessly took away the life of a mother of three children,” said District Attorney Vance. “His DNA was found under his victim’s fingernails, indicating there was a struggle as the victim fought for her life. I hope that the verdict and today’s sentencing brings a small measure of peace to the victim’s family, and I thank Judge Wiley for delivering an appropriate sentence for this vicious crime.”

On the evening of July 7, 2009, PABON was working as a freight elevator operator at an office building at 2 Rector Street, where Rodriguez also worked as a member of the cleaning staff. PABON followed Rodriguez to the 8th floor of the building, where he attacked her and suffocated her with industrial tape. The defendant then used the freight elevator that he operated to transport her body to the 12th floor and hide her body in an air duct, where it was discovered four days later.

Assistant District Attorneys Christine Keenan and Virginia Nguyen prosecuted the case, under the supervision of Trial Bureau 40 Chief Armand Durastanti. Assistant District Attorney Ann Prunty, Counsel to the Trial Division, and Trial Preparation Assistant Colin Stroud also assisted with the case.
