EEOC Sues Haven Manor For Refusing To Accept Hearing-Impaired Certified Nursing Assistant Lincoln Assisted Living Facility Violated Federal Law, Agency Charged LINCOLN, Neb. – Haven Manor, Inc. violated the Americans with Disabilities Act (ADA) when it refused to accept temporary placement of Amanda Huff, a hearing-impaired certified nursing assistant (CNA), at its assisted living facility in Lincoln, Neb., the U.S. Equal Employment Oppor­tunity Commission (EEOC) charged in a lawsuit filed today. In its lawsuit (Case No. 4:10-cv-03108), filed in U.S. District Court in Lincoln, the EEOC claimed that in September 2007, Willingham Health Services, a staffing agency, sent Amanda Huff to Haven Manor in response for a request for a CNA to cover short-staffing on the evening shift. CUOMO’S HIDDEN-CAMERA INVESTIGATION LEADS TO 22 ARRESTS FOR PATIENT NEGLECT AT WNY AND CAPITAL REGION NURSING HOMES

ALBANY, NY (March 31, 2010) - Attorney General Andrew M. Cuomo today announced that his Medicaid Fraud Control Unit (MFCU) has arrested 22 current and former health care workers in two separate cases after footage from hidden surveillance cameras revealed alleged neglect and other conduct that endangered dependent residents. The first case involves the arrest of 14 individuals regarding incidents at Northwoods Rehabilitation and Extended Care Facility in Troy. The second case involves the arrest of 8 individuals regarding incidents at the Williamsville Suburban Nursing Home in Amherst. “With the consent of family members, we put hidden cameras in nursing homes across the state, watching over the vulnerable who often cannot advocate for themselves,” said Attorney General Cuomo. “My office is strongly committed to using all the tools at our disposal to make sure people are getting the medical treatment and the care they deserve.”

Plattsburgh Resident Faces Felony Charges in Cuomo’s Ongoing Probe of Misconduct at Nursing Homes Across New York ALBANY, N.Y. (August 6, 2009) - Attorney General Andrew M. Cuomo announced the arrest of a Plattsburgh certified nurse aide (CNA) accused of text messaging a co-worker an inappropriate photo of a nursing home patient under his care. The felony complaint filed in Plattsburgh City Court charges Shane Spooner, 33, of Standish Street, Plattsburgh, New York, with unlawful surveillance in the second degree and dissemination of an unlawful surveillance image in the first degree, both class E felonies. Spooner, who is no longer employed at the nursing home, was arraigned before Judge Penelope Clute this morning.
