Unlawful Discrimination Based on Pregnancy and Caregiving Responsibilities Widespread Problem, Panelists Tell EEOC

Despite Laws, Guidance and Willingness to Work, Many Pregnant Women and Caregivers are Denied Job Opportunities, Workplace Modifications, Leave, and Equal Treatment WASHINGTON—At a time when most pregnant women want and need to work, and more American workers struggle to balance work and family, discrimination against pregnant women and workers with caregiving responsibilities remains a significant problem, experts told the U.S. Equal Employment Opportunity Commission at a public meeting today. The meeting follows up on Commission meetings in 2007, when the Commission issued its groundbreaking “Enforcement Guidance on Unlawful Disparate Treatment of Workers with Caregiving Responsibilities” and in 2009 when the Commission issued “Employer Best Practices for Workers with Caregiving Responsibilities.”

Justice Department Sues Nation’s Largest Mortgage Insurance Provider for Discrimination Against Women on Paid Maternity Leave

WASHINGTON – The Justice Department announced today that it has sued the Mortgage Guaranty Insurance Corporation (MGIC), the nation’s largest mortgage insurance company, and two of its underwriters, Elgina Cunningham and Kelly Kane, for violating the Fair Housing Act by discriminating against women on paid maternity leave.     The suit, filed on July 5, 2011, in the U.S. District Court for the Western District of Pennsylvania, alleges that MGIC required women on paid maternity leave to return to work before the company would insure their mortgages. Most mortgage lenders require applicants seeking to borrow more than 80 percent of their home’s value to obtain mortgage insurance, meaning MGIC’s denials to women on maternity leave could cost those women the opportunity to obtain a home loan.   “No woman should be denied the opportunity to receive a mortgage loan simply because she has just given birth,” said Thomas E. Indiana Health Centers, Inc. To Pay $45,000 To Settle EEOC Pregnancy Discrimination Suit

INDIANAPOLIS – A statewide health care provider with a dental clinic in South Bend, Ind., will pay $45,000 to settle a sex/pregnancy discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The EEOC charged in its suit (Case no.: 3:10-CV-412-PPS-CAN in U.S. District Court for the Northern District of Indiana, South Bend Division) that Indiana Health Center, Inc. violated federal law when it terminated a female dental hygienist because of her sex/pregnancy and because she was scheduled to go on leave within days of her termination.

Federal Agency Alleged Better Family Life, Inc. Refused to Hire Pregnant Woman

ST. LOUIS – Better Family Life, Inc., a community development organization, will pay $35,000 to settle a pregnancy discrimination suit filed last year by U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. In its suit, the agency alleged that in January 2009 a company representative telephoned a former employee to offer her a job as an employment lead trainer. Before the call ended, the former employee told the representative that she was pregnant. According to the EEOC, the representative called back a few days later to rescind the job offer because of the former employee’s pregnancy.
