DISTRICT ATTORNEY VANCE ANNOUNCES SENTENCING IN NURSING HOME SEX ABUSE CASE

Jose Ramos Sentenced to Maximum Prison Term, Speech-Impaired Victim Used Letter Board and Translator to Testify

Manhattan District Attorney Cyrus R. Vance, Jr., today announced the conviction and sentencing of JOSE RAMOS, a nursing aide at Amsterdam Nursing Home in Morningside Heights, for sexually abusing a disabled and speech-impaired 61-year-old resident of that facility. Today RAMOS was sentenced to seven years in state prison on one count of Sex Abuse in the First Degree, one and one-third to four years in state prison on one count of Endangering the Welfare of a Vulnerable Elderly Person in the Second Degree, and one year in jail on one count of Endangering the Welfare of a Physically Disabled Person, to run concurrently. Upon his release, RAMOS will be under post-release supervision for ten years and will be required to register as a sex offender.

“The defendant preyed upon a helpless victim,” said District Attorney Vance. “Much trust is placed in the hands of those that take care of dependent elderly. The defendant broke that trust and, rather than protecting the safety of the victim, he violated her in deplorable ways. Our Sex Crimes and Elder Abuse Units are committed to seeking justice for victims of sexual violence and elder abuse, no matter how challenging the circumstance of the case.”

As disclosed at trial, the victim became a resident at the nursing home after a stroke that left her partially paralyzed and unable to speak, and was considered “completely dependent” by the nursing home staff. RAMOS, who was assigned to attend to the victim during the midnight shift, was inside the victim’s room under the guise of assisting her with her personal hygiene. After the nurse on duty saw the victim’s call light come on three separate times, the nurse entered the room and found RAMOS sexually abusing the victim. Despite being non-verbal, the victim testified at trial by pointing to letters on a page that were read aloud by an interpreter to spell the words she could not articulate.

DA Vance thanked Assistant District Attorneys Courtney Groves and Shira Arnow, who handled the prosecution of this case under the supervision of Assistant District Attorney Lisa Friel, Chief of the Sex Crimes Unit, Assistant District Attorney Elizabeth Loewy, Chief of the Elder Abuse Unit, Assistant District Attorney Audrey Moore, Chief of Special Victims Bureau, Assistant District Attorney Eugene Porcaro, Chief of Trial Bureau 30, Assistant District Attorney John Brancato, Deputy Chief of Trial Bureau 30, and Assistant District Attorney Connie Fernandez, Deputy Chief of Trial Bureau 30.
